By downloading or using HemiSky (the "App") and the HemiSky service (the "Service"), you agree to these Terms. If you do not agree, do not use the App.
HemiSky transfers files directly between devices, end-to-end encrypted. Most transfers never pass through our servers. Optional server-backed features — discovery, offline delivery, browser download links and drop links — route limited metadata and, for browser delivery, a temporary encrypted copy of the shared file through the Service.
You agree not to use HemiSky to distribute unlawful content, infringe others' rights, transmit malware, or abuse the Service (including attempts to overload, probe, or circumvent its limits). We may suspend accounts or revoke links that violate these Terms.
Core device-to-device transfers are free and unlimited. Optional paid plans raise the limits on the server-backed features. Paid plans are billed through our payment processor; you may cancel at any time, and cancellation stops future billing without refund of the current period unless required by law.
You retain all rights to the files you send. You are responsible for the content you transfer and for having the right to transfer it. We do not claim ownership of your files and cannot read files sent app-to-app.
The Service is provided "as is" and "as available". We may change, suspend, or discontinue features, and we may update these Terms; continued use after changes means you accept them.
To the maximum extent permitted by law, Reasontronic LLC disclaims all warranties and is not liable for indirect, incidental, or consequential damages, or for lost data or files. Our total liability is limited to the amount you paid us in the twelve months before the claim.
